These Terms of Service (“Terms”) govern your access to and use of BEsERP (the “Service”), operated by [LEGAL ENTITY NAME](“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BEsERP is an SEO execution platform. It offers free tools (keyword intelligence, competitor benchmarking, competitor keywords, and site audit) that require no account, and a paid project workspace with additional features such as content briefs, refresh plans, internal link intelligence, and reporting.

2. Accounts and verification

To use account-based features you must register with accurate information and verify your email address using the one-time code we send. You are responsible for keeping your login credentials secure and for all activity under your account. You must be at least 18 years old and able to form a binding contract.

3. Acceptable use

You agree not to:

• use the Service unlawfully or in breach of any third party's rights;
• attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service;
• resell or redistribute the Service or its outputs except as permitted;
• submit data you do not have the right to process.

4. Your data and content

You retain ownership of the keyword exports, URLs, and other content you import or analyse. You grant us a limited licence to process that content solely to provide the Service to you (including sending it to our sub-processors as described in the Privacy Policy). You are responsible for ensuring you have the rights to import and analyse any data you submit, including data about third-party websites.

5. Paid plans and billing

Paid plans may be offered on a self-serve basis via Stripe or arranged following a demo with our team. Fees, billing intervals, and usage limits are presented at the point of purchase or during the sales process. Subscriptions renew automatically until cancelled. Except where required by law, fees are non-refundable. We may change pricing on reasonable notice.

6. Free tools

The free tools are provided “as is” for your use without an account. We may apply fair-use rate limits and may change or withdraw free features at any time.

7. Disclaimers

The Service provides analysis, recommendations, and data from third-party sources. We do not guarantee any particular SEO outcome, ranking, or traffic result. Search engine behaviour is outside our control. Third-party data (e.g. search volumes, rankings) is provided by external providers and may be approximate. To the maximum extent permitted by law, the Service is provided without warranties of any kind.

8. Limitation of liability

Nothing in these Terms excludes liability that cannot be excluded under law. Subject to that, we are not liable for indirect or consequential loss, loss of profits, revenue, or data, and our total liability arising from the Service is limited to the amount you paid us in the 12 months before the claim (or £100 if you use only the free tools).

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends; sections intended to survive (e.g. data ownership, disclaimers, liability) remain in effect.

10. Governing law

These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, without affecting any mandatory consumer protections in your country of residence.

11. Changes

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, notified to you. Continued use after changes take effect constitutes acceptance.
